§ III-D

Application of district regulations

  • 1. When a lot is transected by a Zoning District Boundary, the regulations of this Ordinance applicable to the larger part by area of such lot may also, at the option of the lot owner, be deemed to govern the smaller part beyond such Zoning District Boundary but only to a distance of not more than forty linear feet (40') in depth beyond such zoning District Boundary.
  • 2. No building shall be erected except on a lot fronting on a public street, and there shall be not more than one (1) principal building on any lot, except as allowed under this Ordinance.
  • 3. No accessory building in a residential district may be converted to a principal use.
  • 4. Notwithstanding any other provisions of this ordinance to the contrary, any structures, buildings and land owned, leased or used by the Town of Portsmouth may be erected, enlarged, or used by the Town of Portsmouth in the performance of its governmental functions, in any district, and said structures, buildings or lands so erected, enlarged, or used shall be exempt from the provisions of this ordinance.
