Expiration of Variance or Special Use Permit

A variance or special use permit shall expire one (1) year from the date of granting by the board unless the applicant exercises the permission granted or receives a permit to do so and commences the construction or use so granted.  The zoning board of review may, upon receipt of an application for extension, grant an extension, provided that no more than one (1) extension for a period of one (1) year shall be granted.  An application for an extension shall be in the form of a petition outlining the original variance or special use permit grant together with a notarized letter of explanation as to the reasons for the delay in implementing said variance or special use permit thereof. Such a request shall be filed with the zoning office prior to the expiration of the grant, and the applicant shall appear at a designated meeting for explanation of the details surrounding the request for an extension of the originally granted application.
