Vested Rights

Nothing contained in this ordinance shall restrict or be construed to restrict applications for development which are substantially complete and have been submitted for approval to the appropriate city agency prior to enactment or amendment of this ordinance.  Such applications for development shall be reviewed according to the regulations applicable in the zoning ordinance in force at the time the application was submitted.  If any such application for development is approved, development of the subject property shall commence within one (1) year of the date of approval and shall be completed within two (2) years of the date of approval.  For the purposes of this subsection, an application for development shall be considered substantially complete when all documents and plans required by ordinance, rule or regulation in existence at the time of application, together with all required fees, are received by the official or officials designated to receive such documents, plans and fees.
